AN ACT TO AMEND SECTION 1-3-11, MISSISSIPPI CODE OF 1972, TO REVISE GENERAL DEFINITION OF FELONY; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. Section 1-3-11, Mississippi Code of 1972, is amended as follows:
1-3-11. The term "felony," when used in any statute, shall mean any violation of law * * *:
(a) Specifically classified as a felony in the statute creating the offense or its punishment; or
(b) Any offense in which the maximum punishment authorized by law is:
(i) Imprisonment in the state penitentiary; or
(ii) Imprisonment in the custody of the Department of Corrections; or
(iii) Imprisonment for a period of one year or more, or for life; or
(iv) Death.
SECTION 2. This act shall take effect and be in force from and after July 1, 1999.
